Appeals court: Night club not on hook for man's brain injury allegedly caused by bouncer opening door

A state appeals court has upheld the dismissal of a lawsuit that attempted to make a night club in suburban Burbank pay for the injuries suffered by a man who was struck by an outward opening door on New Year's Eve 2012, saying the man should have recognized the danger of standing in front of the door when the club had posted a sign denying reentry to anyone outside.

A Chicago federal appellate court has stripped class-action status from a suit, which alleges Blue Cross Blue Shield affiliates overcharged beneficiaries, then passed the profits back to Blue Cross, saying a Springfield federal judge overlooked “glaring problems” when allowing the suit to proceed as a class action.

A lawyer’s failure to file an appeal on time may have technically torpedoed a family’s lawsuit against another attorney who they blame for destroying their businesses. But an appellate panel has determined the family would have lost the appeal and the case anyway, and so has denied the family’s attempt to sue its attorney for losing the suit.
