Parking lot injury leads to court action

A pedestrian injured when struck by a car in a Palos Heights parking lot is suing the vehicle's driver.

James Novak filed a lawsuit June 16 in Cook County Circuit Court against Dana Dooley, alleging negligence.

According to the complaint, at 4:20 p.m. June 17, 2013, Novak was walking in the parking lot of ManorCare Health Services, 7850 W. College Drive, Palos Heights, when Dooley, who was driving through the lot, struck the plaintiff, causing disabling injuries to Novak's head, body and limbs, as well as pain and suffering, plus medical expense.

The suit says Dooley was negligent for failing to exercise due care, drive a safe distance from a pedestrian, drive at a safe speed for the conditions, keep a proper lookout, yield to pedestrians and operate her vehicle safely.

Novak seeks damages in excess of the court's jurisdictional limit, plus costs. He is represented by attorney Brent R. Eames of Whiteside and Goldberg in Chicago.
