Truck driver files suit over alleged injury sustained while securing steel load at Atlas Tube

A truck driver is suing after he was allegedly injured trying to secure a steel load at a Chicago manufacturing plant.

Jan H. Tator and Marjorie L. Tator filed suit June 26 in Cook County Circuit Court against John Maneely Co., also known as JMC Steel Group, and Atlas Tube.

According to the complaint, Jan was operating a tractor trailer at Atlas Tube's facility at 1855 E. 122nd St. in Chicago on Aug. 6, 2012 to pick up a load of tubular steel products.

After receiving the load, Jan alleges he fell from the top of the truck and sustained severe injuries after attempting to secure the products with a tarp provided by the defendants.

He accuses the defendants of failing to provide fall protection, a safe working area and equipment to assist him in the installation of the tarp.

The Tators are seeking damages in excess of $50,000 and are represented by Chicago attorneys Joseph A. Power Jr. and Sean M. Houlihan of Power Rogers & Smith P.C.
