A man is suing over claims he developed serious ulcers while a resident at an Elmwood Park nursing home.

Terrance Kirby filed a lawsuit July 16 in the Cook County Circuit Court against Elmwood Care Inc., alleging violations of the Illinois Nursing Home Care Act.

According to the complaint, Kirby was a resident at Elmwood Care Inc. on Feb. 23, 2013, when he was hospitalized for a fever and doctors found a stage III ulcer. Kirby claims he returned to Elmwood Care, and throughout April, May and June 2013, was diagnosed with necrotic ulcers that required surgery.

In September, the suit states he was diagnosed with sepsis and ulcers so deep they extended to the bone. The defendant is accused of negligence and failing to prevent, diagnose or treat Kirby's serious ulcers.

Kirby is seeking more than $50,000 in damages and is being represented in the case by attorney Brian J. Holmes of Hurley, McKenna & Mertz P.C. in Chicago.
