A man has withdrawn his lawsuit accusing a Chicago lawyer of malpractice.
On July 6, 2016, a Cook County judge granted the request by plaintiff Johnny Barginear to voluntarily dismiss his legal action against attorney John J. Budin and Budin Law Offices. The dismissal was without prejudice, and he was granted leave to refile within a year.
Barginear had filed his legal malpractice claim July 30, 2014, in Cook County Circuit Court.
According to the complaint, Barginear hired the defendants to recover damages for a personal injury he sustained on a wet floor at a McDonald's on Oct. 16, 2011, but did not file a lawsuit before the statute of limitations ran out on Oct. 16, 2013.
He had sought more than $50,000 in damages he claims he would have been able to recover had the defendants filed his lawsuit. He was represented in the case by Jeffrey S. Deutschman of Deutschman & Associates in Chicago.
