A married couple has taken legal action against a major construction company, alleging negligence that led to severe injuries. On April 21, 2025, Eduardo Carbajal and Bianca Carbajal filed a complaint in the Circuit Court of Cook County, Illinois, against Gilbane Building Company. The lawsuit claims that the company's failure to maintain safety standards at a construction site resulted in Eduardo's serious injury.

The plaintiffs, Eduardo and Bianca Carbajal, assert that on December 2, 2024, Eduardo was working at a job site managed by Gilbane Building Company at Oak Park River Forest High School in Cook County, Illinois. The complaint outlines how Gilbane was responsible for overseeing the safety and management of the construction project but allegedly failed to fulfill these duties. According to the court documents, "Gilbane had duties to exercise ordinary care for Eduardo’s safety," yet they purportedly neglected these responsibilities by allowing unsafe conditions to persist. This negligence reportedly led to an incident where an auger fell on Eduardo after being left unsupported and standing upright.

Eduardo's claim is based on multiple allegations of negligence against Gilbane Building Company. The lawsuit details several breaches of duty by Gilbane, including failing to stop unsafe practices such as leaving equipment unattended and not ensuring compliance with Occupational Safety and Health Administration (OSHA) regulations. Specifically, the complaint accuses Gilbane of violating OSHA standards like failing to supervise work properly and not providing adequate training or safety measures for workers on-site. As a result of these alleged failures, Eduardo sustained severe injuries with lasting economic and non-economic damages.

Bianca Carbajal also filed a claim within the same lawsuit citing loss of support and companionship due to her husband's injuries. She alleges that Gilbane's negligence has caused significant emotional distress and disruption in their marital relationship. Bianca seeks compensation for both past and future losses related to her husband's injury-induced absence from their life together.

The Carvajals are seeking judgments exceeding $50,000 each from Gilbane Building Company for damages incurred due to their alleged negligence. They request compensation covering litigation costs as well as pre-judgment interest under Illinois statutes.
