BMW, tow service face suit from man who car was rolled over foot

A Cook County man who claims a tow truck driver pushed his broken down BMW over his foot is suing the car company and towing service.

Ben Moshiri filed a lawsuit Aug. 5 in the Cook County Circuit Court against B&R Towing LLC and BMW North America LLC, alleging negligence.

According to the complaint, Moshiri called BMW roadside assistance on Aug. 13, 2012, because his car would not start, and BMW sent B&R Towing to pick up the car at Moshiri's residence on North Dearborn Street to tow it to a BMW dealer.

Moshiri claims the tow truck driver left his truck outside the parking garage and requested Moshiri's assistance in pushing the car to the truck. When he complied, the suit alleges the driver pushed the car over Moshiri's foot and ankle, causing serious injury.

He is seeking more than $50,000 in damages and is being represented in the case by attorney Adam Marquardt of Brustin & Lundblad Ltd. in Chicago.
