A restaurant and bar in the city's Norwood Park neighborhood is facing a lawsuit from a customer who alleges another patron got drunk and started a fight with him.
Thomas Maloney filed suit Nov. 12 in Cook County Circuit Court against Iron Horse Tavern, doing business as Iron Horse Ale House, and Joseph Haugh.
According to the complaint, Maloney was visiting the Iron Horse Ale House at 6158 N. Northwest Highway as a patron on Nov. 17, 2013, when Haugh, also a patron, became rowdy and intoxicated and began fighting with other customers.
Maloney says Haugh struck him in the head, body and eyes with his fist and attempted to choke him by slamming his head into the concrete. Haugh, the suit alleges, continued to strike and punch Maloney, causing serious and permanent injuries.
The plaintiff is suing Iron Horse under the state's Dram Shop Act, and alleges it failed to provide adequate and well-trained security staff to ensure a safe atmosphere for patrons. Haugh is being sued for battery.
Maloney is seeking an award of damages to cover medical and other expenses, as well as punitive damages, and is represented by Chicago attorney Joseph V. Roddy.
