Security guard claims he was hit by forklift at Menards in Fox Lake

A Lake Villa couple is suing the owner of a chain of home improvement stores, claiming its negligence led the man to get hit by a forklift while working.

David Thompson and Lucy Thompson filed a complaint Nov. 13 in Cook County Circuit Court against Menard Inc.

According to the complaint, David Thompson reported to work as a security guard at the Menards at 1400 S. US Highway 12 in Fox Lake on April 24, 2013, when an employee of the defendant who was operating a forklift near the guard shack hit Thompson with the forklift and ran over his foot.

Thompson alleges he sustained severe and permanent injuries as a result of the incident. He claims the defendant, individually and through its employee, failed to operate the forklift in a safe manner, keep proper lookout, yield to pedestrians and instruct its employees on how to use the forklift.

Thompson and his wife, who is suing for a loss of consortium, are each seeking more than $30,000 in damages, plus court costs. They are represented by attorney Mark J. Vogg of the Law Offices of Thomas J. Popovich in McHenry.
