A Carol Stream-based distributor of foliage is suing a Chicagoland florist it contends has an unpaid balance of nearly $35,000.

Chicago Foliage Inc. brought suit Feb. 4 in the Circuit Court of Cook County against Fleur Tatious Designs Ltd., and its owner, Elizabeth Wilkins, alleging breach of contract.

According to Chicago Foliage, it entered into an agreement with Fleur Tatious Designs in January 2013 for the purpose of selling interior plants, with a standing agreement that the defendant would pay the account balance within 30 days.

The plaintiff claims that after allowing the outstanding balance to accumulate to the amount of $68,073.11, Fleur Tatious Designs Ltd. agreed to pay the balance through an installment plan in February 2014.

Fleur Tatious Designs, however, has since failed to render payment, according to the suit that seeks judgment in the amount of $34,977.98, plus court costs and attorney's fees.

Chicago Foliage is owned by Michael Langhammer and is represented by The Law Office of David W. Clark in Wheaton.
