Railroad worker files FELA suit over twisted ankle

A railroad switchman is suing his employer over a 2013 work accident.

Kendall N. Donaldson filed suit March 4 in Cook County Circuit Court against CSX Transportation Inc..

According to the complaint, Donaldson was injured at work while walking in the defendant’s 93rd Street Yard in Chicago on March 6, 2013, when he twisted his ankle on a ballast near the 9/10 tracks.

Alleging violations of the Federal Employers’ Liability Act, Donaldson accuses the defendant of failing to provide him with a safe workplace, a walkway with a reasonably uniform surface, any warning about the uneven surface and sufficient lighting in the area.

Donaldson seeks damages in excess of $50,000, plus attorney fees and costs, and is represented by attorney John Papa of Callis, Papa, Hale & Szewcyk in Granite City.
