Man sues over bicycle-vehicle collision at gas station

A bicyclist is suing over injuries he allegedly incurred in a vehicle accident while crossing a private driveway at a BP service station. 

Richard Guerrero filed a complaint on June 19 in Cook County Circuit Court against Adam Gallegos and BP Petroleum Inc.

On June 20, 2013, Guerrero was riding a bicycle west on a sidewalk parallel to West Archer Avenue, near the driveway to the BP Gas Station at 6751 W. Archer Ave., Chicago.

At that time, Gallegos was making a right turn from the station onto West Archer Avenue in his 2010 Chevy Malibu, at which point he struck Guerrero's bike, causing him injures and damages.

Gallegos is cited with driving unnecessarily close to a bicyclist, at a high rate of speed, moving into another lane unsafely, turning unsafely, and failing to exercise due care, apply his brakes, decrease his speed, yield the right of way, stop before turning from a private road, signal his intention to turn, exercise proper control and keep a proper lookout.

BP is cited with having obstructive signs on its fence, locating its driveway to affect the public safety, maintaining its premises according to local code, warn of a hazardous condition, warning of a vision obstruction and violating city code for gas stations.

The plaintiff seeks damages of more than $100,000, plus costs. The plaintiff is represented by Joseph T. Vietri, of Keating Law Offices P.C., in Chicago.
