Trucker seeks name of forklift operator in workplace accident

A truck driver is suing Menard's, seeking the name of a forklift operator who allegedly caused a load to fall on him.

Jan Piekarewicz filed a lawsuit June 23 in Cook County Circuit Court against Menard Inc., doing business as Menard's.

According to the complaint, on April 21, Piekarewicz drove a flatbed tractor-trailer to the Menard's store at 2601 N. Clybourn Ave., Chicago. The suit says the plaintiff exited the vehicle and removed straps from a previous load but when he'd finished one side of the vehicle's straps and was moving to the other side the load fell on him.

As a result, Piekarewicz sustained injuries requiring treatment in the Level I trauma center at the Illinois Masonic Medical Center, pain and suffering, and medical expense, the lawsuit states.

Piekarewicz seeks a court order to learn the name of the forklift operator who attempted to remove his load before the plaintiff was ready for it to be removed. He is represented by attorney Joseph W. Balesteri of Power Rogers & Smith in Chicago.
