Patient's falls blamed on nursing home negligence

A woman's estate is suing a nursing home, alleging negligence in the woman's falls at the facility.

Billy Waites, individually and as administrator of the estate of Lulu Waites, filed a lawsuit June 26 in Cook County Circuit Court against Warren Barr Pavilion, alleging negligence.

According to the complaint, from June 5-July 22, 2013, Lulu Waites was an 87-year-old resident of the defendant's rehabilitation and nursing care center, at 66 W. Oak St., Chicago. On July 22, the lawsuit states, she suffered her fifth fall while living there, a fall which broke her hip.

The suit alleges Warren Barr Pavilion failed to: properly supervise Lulu Waites, adequately institute proper safety procedures, and conduct care in a way that protected her from harm. As a result, the lawsuit states, Waites sustained an injury requiring her hip to be pinned in place, pain and suffering, disability, disfigurement, plus surgery and medical expense.

Billy Waites seeks damages in excess of the court's jurisdictional limits. He is represented by attorney Sturgis E. Chadwick of Chadwick and Lakerdas in Chicago.
