Woman takes grocer to court over toppling bottle

A Cook County woman filed a lawsuit against a grocery business, claiming that she was severely injured in 2013 by a falling soda bottle on the defendant’s premises.

Mekina Gardner brought a complaint against Jewel Food Stores Inc. d/b/a Jewel-Osco on July 7 in Cook County Circuit Court, alleging damages in the October 2013 store incident.

According to the filing, was shopping at the defendant’s location at 438 W. Madison Street in Oak Park on or about Oct. 9, 2013, when a clerk dropped or otherwise caused a large soda bottle to fall. The suit states that the bottle struck the plaintiff’s right ankle.

The grievance states that the defendant was in breach of duty to use reasonable care in maintaining its shopping aisles. Gardner blames the store for failing to provide a safe walkway for customers, properly train its staff, supervise the employee who was restocking shelves to insure customer safety, and failing to handle merchandise safely.

Court documents indicate that Gardner claims “significant injuries and resulting damages.” The medical nature and consequences of her injury were not further documented.

Seeking damages, attorneys’ fees and costs, the plaintiff is represented by Gabriel Hardy of Goodman, Tovrov, Hardy & Johnson in Chicago.
