Pedestrian files suit against driver following intersection collision

A Cook County woman filed suit against a driver, claiming injuries in a 2013 motor vehicle-pedestrian accident.

Carina Loza of Skokie brought a lawsuit against Jordan Simonetti of Chicago on July 7 in Cook County Circuit Court, alleging in the September 2013 incident.

According to the filing, Loza was crossing 167th Street near its intersection with Halsted Street in Harvey, walking towards a parking lot, on or about Sept. 1, 2013.

The suit states that Simonetti breached her duty to operate her vehicle safely and to exercise ordinary care when her car collided with the plaintiff, causing her to sustain injuries. The lawsuit claims that the defendant failed to keep an adequate lookout, allowed herself to become distracted, drove too fast for the circumstances, and neglected to take evasive action to avoid the collision.

The plaintiff alleges severe and permanent injuries, disfigurement, lost work time and earning capacity, medical bills, and loss of normal life. Court documents include a police report with her claim.

Loza seeks damages in excess of $50,000 plus attorney’s fees and costs. She is represented in the case by Daniel Seidman of Seidman Margulis & Fairman in Chicago.
