Worker alleges builder's negligence led to hand injury

A Cook County man is suing a construction company and two employees, alleging negligence caused a violent machine-related injury that left the plaintiff with permanent injuries.

Kerry Burke filed a lawsuit July 7 in Cook County Circuit Court against Spectrum Construction, Nazneen Rizvi and Sayed Rizvi, alleging negligence and carelessness caused severe physical injuries in the 2013 incident.

According to the filing, on Oct. 6, 2013, Burke was injured when a tool handled by Nazneen Rizvi or Sayed Rizvi struck him, damaging his hand and other body parts. The suit says the plaintiff's injuries were a direct and proximate result of the defendants’ careless and negligent acts and/or omissions and the defendants should have known of the hazards.

The lawsuit states the defendants were negligent in failing to provide the plaintiff with reasonably safe working conditions, warning signs or other mechanisms in the immediate area, and neglecting to properly train and instruct personnel using equipment, monitor the equipment and warn the plaintiff of unsafe conditions.

Burke seeks damages in excess of $50,000 plus attorney fees and costs. He is represented by attorney
