Estate sues over fatal auto accident

A man's estate is suing a driver who allegedly caused the man's death in an accident on Chicago's far South Side.

Leighanne Michko, as administrator of the estate of Audiel A. Ayala, filed a complaint July 7 against Leroy Cain.

According to the lawsuit, on April 15, 2014, Ayala was driving west on Brainard Avenue, near Burnham Avenue, in Burnham. Meanwhile, Cain was driving east on Brainard, when he collided with Ayala's vehicle, causing his death.

Cain is cited with negligence and carelessness for driving on the wrong side of the road, without adequate brakes and failing to drive at a safe speed, decrease speed to avoid an accident, sound his horn, keep a proper lookout, and stop to avoid a collision.

The plaintiff seeks damages in excess of the court's jurisdictional limit, plus costs.

The plaintiff is represented by Marta A. Zaborska of O'Connor and Nakos Ltd., in Chicago.
