Injured bicyclist alleges negligence after being hit by vehicle

A bicyclist injured in a collision with a vehicle is suing the vehicle's driver, alleging negligence.

Enza Furio filed a complaint July 14 in Cook County Circuit Court against Mariusz Michalski.

On Dec. 1, 2014, Furio was riding a bicycle in the crosswalk along Milwaukee Avenue in Chicago. Meanwhile, the lawsuit states, Michalski was driving his vehicle west on Milwaukee and, while trying to make a left turn to head south on Milwaukee, struck Furio.

The defendant is cited for negligence for failing to reduce his speed to avoid a collision, maintain control of his vehicle, maintain a proper lookout, exercise due care, operate at a safe speed, keep a proper distance, honk his horn, drive on the right side of the road, stay in the correct lane, turn safely, and yield the right of way.

The plaintiff, as a result, suffered injury, pain and suffering; loss of earning capacity; and medical expenses.

Furio seeks damages of more than $50,000, plus court costs and attorney's fees.
