A pedestrian is suing the driver of a vehicle, alleging it crashed into her while she was using a crosswalk.
Kristy Litz filed a lawsuit July 10 in Cook County Circuit Court against Johann Pape, alleging negligence and careless.
According to the complaint, on July 29, 2013, Litz was walking west in a crosswalk on Cornelia Street at its intersection with Damen Avenue in Chicago and Pape was driving a vehicle north on Damen at Cornelia when Pape struck Litz.
The suit alleges Pape was careless and negligent for failing to obey a stop sign, drive at a safe speed, decrease his speed, have adequate brakes on his vehicle, sound his horn, observe Litz and stop in time to avoid the collision. The plaintiff, as a result, says she sustained injuries, pain and suffering, loss of a normal life and earning capacity, and medical expenses.
Litz seeks damages in excess of the court's jurisdictional limit, plus court costs and attorney fees. She is represented by attorney Jennifer P. Irmen of Blair Caravelli Irmen Law in Chicago.
