A Cook County man is suing the city of Chicago claiming he was injured when a tow truck allegedly lifted and dropped his parked vehicle in a 2014 accident.
Charles Marshall brought a complaint against the city of Chicago on July 13 in Cook County Circuit Court, alleging negligence in the July 2014 incident.
According to the filing, Marshall was injured in the fall caused by a tow truck owned and operated by the city of Chicago on July 21, 2014, at or near 640 W. Harrison St., when the tow truck purportedly lifted the vehicle upwards while the plaintiff was still in the driver’s seat.
The suit states that the tow vehicle dropped Marshall’s automobile with him inside, causing him personal injury. Marshall asserts that at no time did a city employee instruct him on how to properly exit the vehicle or to exercise caution while exiting the vehicle.
The plaintiff alleges that the defendant was in breach of duty to exercise care and caution for his safety.
Marshall seeks damages of more than $50,000 plus attorney’s fees and costs. He is represented in the case by Benjamin Kelly of The Vrdolyak Law Group in Chicago.
