No wheelchair ramp leads to lawsuit for local business, building owner

Wheelchair

A disabled man who must use a wheelchair is suing a local restaurant and its building owner over alleged violations of the Americans with Disabilities Act.

Ollie Franklin Jr. filed a complaint on July 16 in Cook County Circuit Court against Karyn's Cooked, Inc. and 738 North Wells Building LLC.

When Franklin visited the restaurant on May 5, he allegedly discovered that the front entrance only had steps and no handicapped ramp.

Citing violations of the Americans with Disabilities Act and the Illinois Human Rights Act, Franklin seeks a declaratory judgement, an injunction for the defendants to repair the alleged violations, and unspecified damages, plus costs and attorneys' fees.

The plaintiff is represented by John Steele of the Accessibility Law Group in Chicago.

Cook County Circuit Court case No. 2015L007234.
