A Cook County mother is suing a skilled nursing care facility, alleging violation of the Nursing Home Care Act in her son's death that she says followed a physical altercation.
Wilma Moody Walker, as administrator for Larry Thompson, filed a lawsuit July 17 in Cook County Circuit Court against Bria of Forest Edge, and Forest Edge Healthcare & Rehabilitation Center, alleging wrongful death in a 2014 incident.
According to the complaint, on May 22, 2014, Thompson, who resided at the defendant’s facility, 8001 S. Western Ave., Chicago, was assaulted by his roommate. The suit says he suffered blunt head trauma, went into a coma and died June 5, 2014.
The lawsuit states the defendant failed to provide Thompson with adequate personal care and supervision to avoid physical harm, did not properly staff the premises, neglected to screen its residents or place Thompson with an appropriate roommate.
The plaintiff brings the survival action suit in her capacity as Thompson’s mother, alleging the defendant was in violation of law by failing to prevent neglect and abuse.
Walker seeks damages of more than $50,000, plus attorney fees and costs. She is represented by attorney Scott B. Wolfman of the Law Offices of Scott B. Wolfman in Chicago.
