A Cook County resident as estate administrator for her mother, who died in the care of a nursing home. has filed suit against the skilled nursing care facility, claiming violation of the Illinois Nursing Home Care Act in the 2013 death.
Wanda Hudson brought a survival action complaint against Oak Park Healthcare Center LLC on July 13 in Cook County Circuit Court, alleging wrongful death in the November 2013 incident.
According to the filing, Madestine Hudson resided at Oak Park from June 1, 2012, until July 22, 2013. The suit states that the defendant’s employees failed to provide supervision, evaluation, and handling of the patient, failed to adequately assess and document her condition, and failed to safely transfer her from a bed to a wheelchair.
Court documents indicate that on July 21, 2013, Madestine was injured when staff allegedly moved her in an unsafe manner, resulting in a broken hip requiring surgery, disfigurement, disability, loss of a normal life, pain and suffering, mental distress, and medical expenses prior to her death on Nov. 2, 2013.
The suit states that the patient additionally suffered from bedsores and lack of adequate personal care. The plaintiff seeks damages of more than $50,000 plus attorney’s fees and costs. She is represented by James Lynch, of Keating Law Offices in Chicago.
