Popeye’s patron pursues compensation for slip and fall

A Cook County resident is suing a fast-food chain restaurant claiming that a slippery floor caused him injuries in 2014.

Charles Byrd brought a complaint against Evergreen Park Chicken LLC, doing business as Popeye’s Chicken of Evergreen Park, on July 16 in Cook County Circuit Court, alleging premises negligence in the December 2014 incident.

According to the filing, Byrd was a Popeye’s customer on or about Dec. 22, 2014, when he allegedly slipped and fell inside the restaurant on a cleaning solution or other liquid present on the floor.

The suit states that the defendant was in breach of duty to maintain a safe environment when it allowed the substance to be on the floor, and that it failed to inspect the premises and clean up or remove the liquid, warn the plaintiff of the risk of injury, and block, barricade or otherwise prevent Byrd from coming into contact with the hazardous material.

Arguing that Popeye’s created an unreasonable risk of injury, Byrd claims that he has been hindered from attending to ordinary duties and has incurred medical bills. Court documents did not indicate the nature of the plaintiff’s injuries.

The plaintiff seeks damages of more than $50,000 plus attorney’s fees and costs. He is represented in the case by Bradley Pollock of Walsh, Knippen, Pollock & Cetina in Wheaton.
