Near drowing of disabled man leads to court action

A disabled Chicago man and his guardian are suing the city, alleging not properly supervising him in a pool, which led to him starting to drown.

Olutosin Ali, a disabled adult, and his guardian Olufumiola Ali filed a lawsuit July 24 in Cook County Circuit Court against the Chicago Park District, alleging two counts of negligence.

According to the complaint, on July 24, 2014, Olutosin Ali was attending the summer day camp at Palmer Park Water Slides, at 201 E. 111th St., Chicago, and pool monitors found him nearly drowning.

The suit says the defendant failed to: properly supervise Ali and other campers in the pool, warn Ali about the pool dangers, properly staff the pool, have a policy in place to monitor the disabled in the pool, inform staff about any said policy and keep Ali supervised in the pool.

As a result, the lawsuit states, city pool monitors returned to find Ali drowning, which resulted in injuries to his head, limbs and body, pain and suffering, medical expenses and loss of income.

The Alis seek damages of more than $100,000, plus costs. The plaintiffs are represented by attorney Howard S. Abrams of Dworkin & Maciariello of Chicago.
