Kohl's shopper alleges sign fell on her head

A shopper is suing Kohl's, alleging she suffered injuries when an overhead sign fell on her head.

Elaine Smith filed a lawsuit July 24 in Cook County Circuit Court against Kohl's Department Stores Inc., alleging negligence.

According to the complaint, on Nov. 15, 2014, Smith was a customer at Kohl's at 1601 Southlake Mall in Merrillville, Ind., and while shopping, a "large, overhead sign fell from above, hitting the plaintiff on the head." The suit says Smith sustained personal and permanent injuries as well as loss of a normal life, pain and suffering and medical expenses.

The lawsuit alleges Kohl's allowed the sign to become dangerous and failed to maintain its building, inspect the property for safety, correct a dangerous condition, secure the sign correctly and warn the plaintiff of a hazard.

 

The plaintiff seeks damages of more than $50,000, plus costs. She is represented by attorneys Jeffrey S. Deutschman and Bradley A. Skafish of Deutschman & Associates in Chicago.
