A Cook County man is suing a physician and her practice, claiming negligence in 2015 involving an allegedly mistreated broken finger.
Shobhit Kasliwal, of Wheeling, brought a lawsuit against Nereida Rojas and Physicians Immediate Care-Chicago LLC on July 21 in Cook County Circuit Court, alleging medical malpractice in the May 2015 incident.
The suit states Kasliwal came under Rojas’ care on May 7, when the doctor noted skin discoloration and edema in the second index finger and ordered X-rays, which revealed a “right second finger distal phalanx fracture, closed fracture, without IP joint involvement.”
According to the filing, the doctor failed to diagnose a PIP fracture and potential dislocation, negligently treated the plaintiff without proper immobilization, and failed to refer him for orthopedic intervention.
The lawsuit states the plaintiff’s digit was splinted improperly, resulting in increased displacement and permanent damage that required surgery. Additionally, the suit states that because Kasliwal is a computer programmer, the additional injury led to economic losses.
Claiming pain and suffering, loss of normal life, disfigurement and disability, the plaintiff demands judgment of more than $50,000, plus attorneys’ fees and costs. He is represented by Erron Fisher of Fisher & Lamonica in Chicago.
