Pedestrian sues driver who allegedly struck her within crosswalk

A couple is suing a motorist claiming vehicular negligence in a 2014 pedestrian collision in Chicago that purportedly injured the wife.

Aparna Desai and Hemal Desai brought a lawsuit against Brittany Czischki of Glendale Heights in Cook County Circuit Court on July 27, alleging negligence in a June run-in involving the defendant’s vehicle.

According to the filing, Aparna was walking westward on a Hubbard Street crosswalk at or near its intersection with La Salle Street on June 29 when Czischki allegedly struck her with her motor vehicle.

The plaintiffs charge the defendant with failure to control her vehicle, yield to a pedestrian traveling lawfully in a crosswalk, exercise due care to prevent striking a pedestrian, drive at a proper speed for the traffic conditions and highway usage, and maintain a proper lookout.

The lawsuit states that Aparna suffered personal and pecuniary injuries; and that Hemal has suffered loss of consortium, companionship, society and support as a direct and proximate result of the defendant’s negligent acts or omissions.

The Desais demand judgment in excess of the minimum jurisdictional amount, plus attorneys’ fees and costs. The couple is represented by Benjemin Nichols of The Cavanagh Law Group in Chicago.
