Cook County woman sues Chicago, Bank of America, alleging injuries from fall

A Chicago woman is suing the city of Chicago and Bank of America, alleging injuries from a fall.

Maria Martinez filed a lawsuit Aug. 19 in Cook County Circuit Court against the city of Chicago and Bank of America, alleging negligence for a defective metal grate in the center of the sidewalk in front of the bank’s property.

According to the complaint, on Dec. 4, 2014, near the intersection of Milwaukee and Ashland avenues, the grate caused Martinez to trip and fall, sustaining injuries. The suit says both defendants were aware of the defective grate, but took no action to eliminate this public safety hazard, including regular inspections and maintenance.

The plaintiff charges each defendant with one count of negligence.

Martinez seeks more than $50,000 in damages, plus court costs.  Her legal representation was not listed in the complaint.
