Illinois Medi-Car sued over claims of negligence

A Chicago man is suing following over injury claims after an incident involving medical facilities transportation service Medi-Car Inc..

Robert J. Gersch filed a complaint Aug. 21 in Cook County Circuit Court against Illinois Medi-Car Inc., also known as Superior Paratransit, alleging negligence.

The complaint alleges that on Oct. 11, 2013, a Medi-Car driver helped Gersch exit Northwestern Memorial Healthcare in Cook County after a procedure for which he was sedated.

At the driver's curbside van, Gersch started to get in the Medi-Car that had been arranged to take him home, and, guided by the driver, struck his head with great force on the top of the opening of the van, the complaint alleges.

According to the complaint, Gersch, who was still feeling the effects of the sedation and was now in severe head pain, was instructed to sit in the back of the van while the driver called his supervisor. Then, when they were approximately a half-block away from Gersch's home, the driver pulled the van over and told Gersch to walk the rest of the way, according to the complaint.

The complaint alleges that Medi-Car was negligent in its failure to properly assist Gersch, who was still recovering from the sedation.

As a result, Gersch suffered injuries including pain, incurred medical expenses, disability, and loss of wages.

Gersch seeks compensatory damages.
