Patron who suffered gunshot wounds sues tavern owner

A Cook County woman is suing a Summit tavern after being shot in the tavern parking lot.

Yolanda Soto filed a lawsuit Sept. 2 in Cook County Circuit Court against Michael Rodriguez, individually and doing business as Luv 'N' Music Cafe, Mike's Luv 'N' Music, and Luv 'N' Music, alleging a violation of Illinois' Dram Shop Act and inadequate security.

According to the complaint, on Sept. 20, 2014, Soto was shot by an unidentified person outside Rodriguez's tavern at 5428 S. Harlem Ave., Summit. The suit says the unidentified person had been drinking at Rodriguez's tavern and was intoxicated when he assaulted Soto with a deadly weapon.

The lawsuit also alleges the tavern's security acted carelessly and negligently in its failure to monitor the parking lot, its failure to intercede in the assault, and in allowing and encouraging Soto to leave the tavern when it was unsafe to do so.

As a result of her gunshot wounds, the suit says, Soto has incurred pain, suffering, loss of normal life, medical expenses and has been restricted in her usual activities.

Soto seeks more than $30,000 in compensatory damages, plus court costs.
