Allegedly broken chair injures Advocate Lutheran General Hospital guest, prompting lawsuit for negligence

A man is suing Advocate Lutheran General Hospital for negligence in a dispute surrounding injuries he suffered from an allegedly unsafe chair.

Kenneth Walters filed suit Aug. 31 in Cook County Circuit Court’s Law Division against defendants Advocate Health & Hospitals Corp., doing business as Advocate Lutheran General Hospital; Advocate Lutheran General Hospital; Advocate Health & Hospitals Corp., doing business as Lutheran General Hospital; and Lutheran General Hospital.

According to the lawsuit, on Sept. 3, 2013, Walters was visiting his wife who was a patient at the defendant’s facility. When he attempted to sit in a chair at his wife’s bedside, the chair collapsed down and backwards, causing Walters to fall backward and injure himself. The suit claims the hospital was negligent in providing the unsafe chair for visitors, and as a result, Walters suffered permanent and disabling injuries to his head, body, mind, limbs and nervous system. These injures have required medical expenses and are expected to do so in the future.

Attorney John M. Malloy of the Chicago firm John M. Molloy & Associates is representing Walters in his lawsuit, which seeks more than $50,000 in damages and litigation costs.
