Flagger sues construction firms alleging injury from ricocheted equipment

A Cook County woman is suing three allied commercial construction businesses alleging that their collective negligence caused her personal damages in an accident.

Socorro Contreras of Chicago brought a lawsuit against Ozinga Bros. Inc., Ozinga Ready Mix Concrete Inc. and Pan American Construction Co. in Cook County Circuit Court on an undisclosed date, alleging negligence in a May 2015 project during which she claims to have sustained physical injuries.

The suit states that Contreras, employed as a flagger by a separate company, was working at a construction site at 115th and Homewood in Chicago on or about May 13. According to the complaint, an Ozinga employee drove a cement truck over a jackhammer that had been left on the roadway by a Pan American employee, causing the machine to strike and severely injure Contreras as she stood on the sidewalk.

The plaintiff charges the defendants with negligence by failing to operate the cement truck safely and at an appropriate speed, avoid colliding with equipment, keep a proper lookout, train workers adequately, warn bystanders of the hazard, and retrieve fallen objects from the roadway.

Contreras claims lost income, pain and suffering, disfigurement and loss of a normal life. She requests judgment of more than $50,000, plus attorneys’ fees and costs. The plaintiff is represented by Bashford Law Group and Muir Law Offices in Glenview.
