Man sues Emeritus at Prospect Heights over negligence allegations in elderly woman's hip fracture

A man is suing Emeritus at Prospect Heights regarding injuries an elderly woman allegedly suffered while in the home’s care.

Joseph Giolli, administrator of the estate of Ola Giolli (deceased), filed a claim Sept. 4 in Cook County Circuit Court’s Law Division against Emericare Inc., S-H Opco Prospect Heights LLC and Brookdale Senior Living Inc., all doing business as Emeritus at Prospect Heights.

According to the complaint, between July 8 and Oct. 8, 2013, Ola Giolli was a resident of Emeritus at Prospect Heights, allegedly requiring assistance with daily living. On Sept. 4, Ola fell while using a walker and suffered a hip fracture requiring surgery. The claim states that Emeritus was negligent by not assessing Ola’s condition adequately and by failing to design a treatment plan to avoid potential fall injuries.

Michael E. Holden and Stephan D. Blandin of the Chicago firm Romanucci & Blandin are representing the plaintiff in this action, which seeks a six-person jury trial and damages of more than $50,000 plus attorney’s fees.
