Driver sued over negligence claims in vehicle collision at California Avenue intersection

Three Illinois residents are suing a driver following a collision at intersection of California Avenue and Jackson Boulevard in Chicago over negligence allegations.

Herman Wiley, Lasharndra Scott and Cedric Johnson, the independent administrator of the estate of deceased Derrick Johnson, filed a complaint Aug. 21 in Cook County Circuit Court against Marcos Diaz, citing negligence.

On Aug. 22, 2013, the complaint states, Wiley was driving northbound on California Avenue near the intersection with Jackson Boulevard in Chicago, with Scott and Derrick Johnson as passengers, when Diaz, driving eastbound on Jackson Boulevard approaching the intersection with California Avenue, struck the plaintiffs' vehicle.

The complaint alleges Diaz was negligent in his failure to control his vehicle, keep a proper lookout, yield the right of way, obey the intersection's traffic signal, and for speeding.

As a result of the accident, Wiley, Scott and Derrick Johnson sustained personal injury, pain and suffering, disfigurement and disability and incurred medical bills.

The plaintiffs seek a judgment of more than $50,000, plus costs of the suit.

They are represented by Eric J. Parker of Stotis & Baird Chartered in Chicago.
