An estate representative is suing a construction company on allegations of negligence and wrongful death in a workplace accident that claimed the life of his son.

Patrick R. Wilda brought a lawsuit individually and as independent administrator of the estate of Patrick C. Wilda against Ridge Lego Partners LLC and Ledcor Construction Inc. on Sept. 14 in Cook County Circuit Court, Law Division, alleging that the companies’ failure to provide lawful safety practices resulted in fatal injuries to the younger Wilda in January.

The suit states that the decedent, employed by Area Erectors, was at the defendants’ work site in Wilmington on or about Jan. 30 for a renovation project.

According to the complaint, the defendants were out of compliance with Occupational Safety and Health Administration regulations in their failure to provide a safe workplace, adequate training, staffing, support and supervision, and proper protocol when Patrick C. Wilda was injured by an allegedly improperly operated manlift in the course of moving or connecting large structural beams.

The lawsuit states that the worker suffered internal and external damage, pain and anguish before succumbing to his injuries. Patrick C. Wilda’s surviving family, claiming emotional pain and suffering, invokes the Survival Act and the Family Expense Act for medical bills.

The plaintiff demands judgment in excess of the minimum jurisdictional amount plus attorneys’ fees and costs. He is represented by Clifford Horwitz of Horwitz, Horwitz and Associates in Chicago.
