A diner is suing a Chinese buffet for allegedly serving food unfit for human consumption.
Hernan Perez filed suit Sept. 22 in the Cook County Circuit Court’s Law Division against Ming Brickyard Super China Buffet Inc. on one count each of product liability, negligence and breach of warranty.
The claim states that on Sept. 26, 2013, Perez visited the restaurant known as either Brickyard Super China Buffet or Super China Buffet and ate food prepared and served by the restaurant staff.
According to the claim, while the plaintiff was eating, he bit down on a hard foreign object. The lawsuit states the food was impure and contained impure matter, that the products were adulterated and contaminated with filth, contained a hard object and were therefore unfit for human consumption.
Matthew M. Rundio and Paul R. Struebing of the Cavanaugh Law Group in Chicago are representing the plaintiff, who is seeking a jury trial and damages in excess of the jurisdictional limits of the court, plus costs.
