Trade association alleges former members owe $58,000

An Illinois trade association is suing former members of its self-insurance pool, alleging breach of contract.

The Illinois Association of Building Maintenance Contractors Group Self-Insurers Pool filed a lawsuit Oct. 8 in Cook County Circuit Court against two dissolved corporations, MHCBSG Inc. and MHCRS Inc., and Mark Herbick, a director and shareholder in the two companies.

According to the complaint, the companies withdrew from the IABMC pool once they were sold in March 23, 2010. The suit says the pooling agreement requires repayment of any amounts paid by the pool for claims made against members before withdrawal. The amounts in question include $57,535 in assessments paid on the defendants behalf.

IABMC seeks reimbursement for $57,535, plus $100 per day for late payments, litigation costs and other damages. It is represented by attorney Gerald B. Borden of Borden Law Firm in Chicago.
