Chicago Ridge man says Chicago police deleted incriminating cellphone photos

A Chicago Heights man is suing the city of Chicago and several police officers, alleging they violated his constitutional rights.

Mark Miller filed a lawsuit Oct. 27 in Cook County Circuit Court against the city of Chicago, Chicago police officer Shirley Johnson and unknown Chicago police officers.

According to Miller’s complaint, on Nov. 1, 2014, Johnson told Miller his Dodge truck was parked too close to her squad SUV in the parking lot of Mariano’s in Oak Lawn and directed him to move it. When Johnson said she was citing him for a parking violation, the suit says Miller attempted to photograph her police vehilce and record the conversation on his cellphone.

After Johnson grabbed Miller’s arm and he pulled free, the suit says, Miller was arrested and his cellphone was confiscated. Miller alleges the police deleted pictures from the phone that would have supported his claim that it was Johnson, rather than Miller, who was incorrectly parked.

Miller seeks damages of more than $50,000, plus legal costs. He is represented by attorney Terence J. Mahoney of Neville & Mahoney in Chicago and by Walsh Fewkes & Sterba in Palos Heights.
