Daughter sues Chicago motorist, alleging negligence in father’s fatal car crash

A Cook County woman is suing the driver of a car that she alleges struck and killed her father.

Teagan A. Smith, independent administrator of the estate of Harry J. Smith of Niles, filed a lawsuit Oct. 26 in Cook County Circuit Court against Cerny Enterprises Inc. and William Cerny of Chicago.

According to the complaint, on Aug. 31, both Harry J. Smith and Cerny were driving eastbound on Devon Avenue when Cerny lost control of his Ford Crown Victoria, striking Smith’s Jeep Grand Cherokee and forcing it off the road and into a tree, causing Smith to suffer fatal injuries. The suit says Cerny was drunk and speeding during the accident.

Smith seeks damages of more than $50,000, plus litigation costs. She is represented by attorney Kent D. Sinson of the Sinson Law Group in Chicago.
