A Crest Hill man is suing his grandmother's husband, alleging the defendant's failure to follow doctor’s orders when she recuperated at home caused her death.
Jacob Heinrich, special administrator of the estate of Kathy Koval, filed a lawsuit Nov. 17 in Cook County Circuit Court against Kenneth Koval Sr. of Worth.
According to the complaint, Kathy Koval was sent home on Nov. 26, 2013, from Palos Community Hospital with an oxygen breathing machine and strict orders for Kenneth Koval Sr. not to adjust the machine’s setting past No. 4. When Kathy Koval began having trouble breathing, the suit says, Kenneth Koval turned the machine to No. 6, causing his wife to develop brain damage and subsequently die.
The suit also charges the defendant with failing to seek prompt medical attention.
Heinrich seeks damages of more than $50,000, plus litigation costs. He is represented by attorney Michael A. Moore of the Law Office of Daniel E. Goodman in Rosemont.
