Patient withdraws lawsuit vs Chicago dermatologist over skin cancer diagnosis

A Cook County woman has voluntarily withdrawn her lawsuit against a dermatologist and a hospital group, alleging the defendants failed to detect the early signs of skin cancer.

On Sept. 29, Kate M. Szymanski notified a Cook County judge of her decision to withdraw the lawsuit she had filed Aug. 17 in Cook County Circuit Court against Northwestern Medical Group, Northwestern Medical Faculty Foundation, Northwestern Memorial Hospital and Dr. Arman D. Soleymani. Dermo LLC had been named as a respondent in discovery.

The motion for voluntary dismissal did not disclose why the plaintiff was withdrawing the lawsuit, but reserved the right to refile the legal action within the next year.

According to the complaint, Szymanski was diagnosed with basal cell carcinoma May 14, despite allegedly having been treated by Soleymani for a skin abnormality between 2010, and 2013. The suit accused Soleymani of negligence for failing to order a biopsy of the suspicious area and not prescribing an appropriate course of treatment.

Szymanski was represented by attorneys Patrick A. Salvi, Aaron D. Boeder and Brian L. Salvi of Salvi, Schostok & Pritchard in Chicago.
