Estate of cancer victim files wrongful death suit

CHICAGO – Parents of a cancer victim are taking the doctors who treated their son to court over claims of wrongful death.

Freddie Villacci and Jennifer Villacci, as independent administrators of the estate of Vincent Villacci, filed a lawsuit on Feb. 3 in Cook County Circuit Court against Dr. John F. McFadden, Dr. John Joyce, Suburban Pediatrics LTD and Advanced Radiology Consultants, citing wrongful death.

The plaintiffs assert that their son, Vincent, came to defendant Joyce over complaints of a mass on his right leg on or about Aug. 18, 2008. Defendant Joyce is allegedly a general medical and pediatric care doctor. Defendant McFadden and Advanced Radiology had also allegedly observed Vincent on the same day for the imaging of his right leg.

Plaintiffs attest that Advanced Radiology had failed to mention to them that McFadden was not an employee, staff, or agent of their center. McFadden allegedly told plaintiffs that the mass on Vincent’s right leg was a hemangioma. From Aug. 18, 2008, to May 2, 2009, Vincent was allegedly under the care of defendants. Plaintiffs claim that during that period of care, neither Joyce nor McFadden diagnosed Vincent of cancer or reached a differential diagnosis of cancer. Plaintiffs claim that due to defendant’s failure to adhere to strict medical standards, failure to provide proper medical care and negligent actions, Vincent passed away on June 9, 2010.

They are now suing for damages of more than $50,000, court costs, and any other rewards deemed just by the court. They are seeking a trial by jury and are represented by John F. Winters Jr. and others at the offices of Winters, Salzetta, O’Brien, & Richardson LLC in Chicago.
