Hip replacement patient sues over blood contamination

CHICAGO — A Cook County woman is suing the manufacturer and distributor of an alleged faulty artificial hip replacement device, claiming defects in design.

Margaret Ann Mey filed a lawsuit Feb. 5 in Cook County Circuit Court against DePuy Orthopaedics Inc. and Premier Orthopaedic Sales Inc., alleging product liability.

According to the complaint, Mey began treatment for hip arthritis in 2008 with Dr. Stephen Gabriel. On July 29, 2008, the suit says, Gabriel implanted the DePuy ASR XL into Mey’s right hip. Two years later, the Food & Drug Administration recalled the device for shedding metallic debris in patients’ bodies. After Mey had tested positive for metallic elements in her blood, the unit was removed on Dec. 22, 2015.

The suit alleges the defendants knew the DePuy ASR XL was defective and harmful to consumers, yet allowed Mey and other patients to be implanted with the device.

Mey seeks a jury trial and damages in excess of $50,000. She is represented by attorney Peter J. Flowers of Meyers & Flowers in Chicago.
