Daughter brings wrongful death suit against nursing home

CHICAGO — A Cook County woman says workers at Alden-North Shore nursing home neglected her mother’s supervision, allowing her to fall and break her hip.

Trudy Shaw, independent administrator of the estate of Cora Lee Payne, deceased, filed a lawsuit Feb. 5 in Cook County Circuit Court against Alden-North Shore Rehabilitation and Health Care Center, alleging wrongful death and negligence under the Illinois Nursing Home Care Act.

According to the complaint, Payne resided at the Alden-North Shore facility from 2012-2014, with intermittent hospitalizations. The suit claims staff at the facility failed to protect Payne from abuse and neglect, allowing her to suffer falls and leaving accident hazards in her environment. As a result, the plaintiff says Payne suffered a broken hip and unnecessary pain and suffering, which led to an overall deterioration in her mental and physical condition.

Shaw seeks damages in excess of $50,000. She is represented by attorney Jason B. Rosenthal of the Law Offices of Jason B. Rosenthal P.C. in Chicago.
