Family accuses Orland Park health facility of wrongful death

CHICAGO — A special administrator for an estate is suing an Orland Park health facility, alleging negligence and wrongful death.

Jennifer Chyzy, special administrator of the estate of Delores Chyzy, filed a lawsuit May 3 in Cook County Circuit Court against Lexington Health Care Center of Orland Park, Inc. alleging violations of the Nursing Home Care Reform Act.

According to the complaint, while Delores Chyzy was confined in the defendant's facility, she suffered physical deterioration and severe injuries, which ultimately caused and contributed to her death March 9, 2009. As a result, her daughter and son have suffered great losses of personal and pecuniary nature, including loss of companionship, society, services and comfort, the suit says. 

The plaintiff alleges Lexington Health Care Center failed to provide adequate supervision and personal care for Chyzy, failed to provide adequate maintenance that led to Chyzy's injuries and physical deterioration, failed to hire a properly trained and competent staff and failed to notify a physician in a timely manner of Chyzy's condition.

Jennifer Chyzy seeks a trial by jury compensation of more than $50,000, plus costs of suit. She is represented by attorney Jesse Gonzalez of the Law Offices of Meyer and Blumenshine in Chicago.
