Guardian alleges health care providers' negligence led to ailments

CHICAGO — A guardian is suing Chicago health care providers, alleging their negligence cause a disabled person's health to deteriorate.

Earnestine Gibson, plenary guardian of the estate of Freddie Moore, a disabled person filed a lawsuit May 4 in Cook County Circuit Court against Columbus Park Nursing and Rehabilitation Center Inc., Generations at Columbus Park Inc., Columbus Park LLC and S.I.R. Management, Inc, alleging they violated the Illinois Nursing Home Care Act.

According to the complaint, prior to May 7, 2104, Moore was a resident at the Columbus Park Nursing and Rehabilitation Center due to his medical history that includes chronic airway obstruction, hepatitis A, B, and C, Parkinson's, paralysis agitans, hypertension and anemia.

 On May 7, 2014, the suit says, he was transferred to Loretto Hospital where he was diagnosed suffering from septic shock due to UTI, dehydration and hematuria. As a direct and proximate result, he has suffered pecuniary and personal losses, the lawsuit states. 

The plaintiff alleges the defendants failed to monitor Moore's vital signs, failed to provide adequate hydration, failed to provide reasonable care to prevent urinary track infection, failed to note significant changes in his condition, failed to ensure that he was not subjected to neglect and failed to notify his physician of any injury or significant changes in his condition.

Gibson seeks a trial by jury, more than $50,000 in damages, and other relief the court deems proper. He is represented by attorney Michael Silverman of Horwitz, Horwitz and Associates LTD in Chicago.
