CHICAGO – An estate administrator claims a Des Plaines long-term nursing care facility did not provide proper care, allegedly causing a woman's death.
Debra Schwartz, as independent administrator of the estate of Donna Spence, filed a complaint on July 13 in Cook County Circuit Court against Generations at Oakton Pavillion LLC, doing business as Generations Oakton Pavillion, alleging wrongful death.
According to the complaint, the plaintiff alleges that in 2014 while under the care of the defendant, Spence fell multiple times, which caused lacerations and intracranial hemorrhaging, as well as developed pressure ulcers, contradicted pneumonia and became malnourished. The plaintiff alleges these factors contributed to Spence's death in July 2015. The plaintiff holds Generations at Oakton Pavillion LLC responsible because the defendant allegedly failed to adequately assess Spence, failed to provide adequate supervision and failed to implement an up-to-date resident care plan, among other counts.
The plaintiff requests a trial by jury and seeks judgment against the defendant in an amount of more than $50,000. She is represented by David M. Resis of The Law Offices of Steven J. Malman & Associates PC in Chicago.
