Man claims improper water temperature caused wife's death

CHICAGO — An administrator of his deceased wife's estate is suing Briar Trace Condominium Association; Edward Horak, d/b/a Horak Management; and Boris Kofman, in a wrongful death claim alleging that dangerously hot tap water resulted in his wife's death from scalding injuries.

Rakesh Patel, individually and as independent administrator of the estate of Dipti Patel, filed a complaint on July 21 in Cook County Circuit Court against the defendants, alleging that they failed to properly maintain the water flowing in the plumbing system of their unit in a reasonably safe temperature.

According to the complaint, the plaintiff alleges that on Feb. 8, Dipti Patel sustained fatal injuries as the result of being burned by hot water in the bathroom. The plaintiff holds the defendants responsible because they allegedly set the temperature of the water in their property at a dangerously high level.

The plaintiff seeks judgment against the defendants in an amount in excess of $50,000 plus court costs. He is represented by Ben Crane and Ted C. Jennings of Coplan & Crane in Oak Park.
